1. Scope and Parties
(1) These Terms of Service ("Terms") apply to the use of the mobile application "Kraut" (hereinafter "App") and its associated services and features.
(2) The provider of the App is TechSeed GmbH (hereinafter "Provider" or "we"). Contact: service@kraut.net, https://kraut.net
(3) The contractual partner of the user (hereinafter "User" or "you") is the Provider. By registering or using the App, a contract is established between you and the Provider.
(4) Deviating, conflicting, or supplementary terms and conditions of the User shall not become part of the contract unless their validity is expressly agreed to in writing.
2. Service Description
(1) The "Kraut" App is a mobile application for managing shopping lists and product inventories. The App enables users to:
- Create, manage, and organize shopping lists
- Add products to shopping lists with quantity, unit, price, and notes
- Upload and manage product images
- Identify products via barcode scanning
- Create and manage custom products
- Share shopping lists with other users
- Collaborate on shopping lists with real-time synchronization (Socket.IO)
- Customize product information such as name, brand, and description
- Mark products as purchased and manage purchase history
- Use location-based shopping features (automatic store detection)
- Receive push notifications about shared lists and shopping activities
- See online/offline status of other shared users
(2) The App can be used by both registered and anonymous users. However, full functionality is only available to registered users.
(3) The Provider reserves the right to modify, expand, or restrict the App at any time, provided this is reasonable for the User and does not affect essential contract components.
3. Registration and User Account
(1) Use of the App does not require registration. However, certain features can only be used after registration.
(2) For registration, users can use various authentication methods:
- Google Account
- Apple ID
- Email address
Authentication is provided by Clerk.
(3) The User undertakes to provide truthful, complete, and current information during registration. Changes to this information must be updated immediately in the user account.
(4) The User is obligated to keep login credentials confidential and ensure that third parties do not gain access to their user account. The User is liable for all actions performed using their credentials.
(5) The Provider is entitled to temporarily or permanently block user accounts if there is reasonable suspicion of misuse or violation of these Terms.
4. Use of the App
(1) The User receives a non-exclusive, non-transferable, revocable right to use the App in accordance with these Terms.
(2) The App may only be used for private purposes. Commercial use requires the express written permission of the Provider.
(3) The User undertakes to:
- Use the App only in compliance with applicable law
- Not upload or share content that violates applicable law, the rights of third parties, or good morals
- Not distribute viruses, malware, or other harmful programs through the App
- Not reverse engineer, decompile, or disassemble the App
- Not take any actions that could impair the functionality or security of the App
(4) The User is responsible for all content they create, upload, or share in the App.
(5) The User warrants that they have all necessary rights to the content they upload and that such content does not infringe on the rights of third parties.
5. Privacy
(1) The collection, processing, and use of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws.

6. Liability
(1) The Provider is fully liable for intent and gross negligence, as well as for damages arising from injury to life, body, or health.
(2) For slight negligence, the Provider is only liable for breach of an essential contractual obligation. In this case, liability is limited to foreseeable, typical damages at the time of contract conclusion.
(3) The Provider assumes no liability for:
- Content created, uploaded, or shared by users in the App
- The accuracy, completeness, or timeliness of product information from third parties
- Loss of data or content due to technical disruptions
7. Changes to the Terms
(1) The Provider reserves the right to modify these Terms as necessary to reflect changes in legal requirements, case law, or technical developments.
(2) Changes to the Terms will be communicated to the User via email or notification in the App.
(3) If the User does not object to the modified Terms within 6 weeks of receiving the notification, the modified Terms are deemed approved.
8. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
